Article 3 – Application
These General Terms and Conditions apply to all offers made by the entrepreneur and to all distance contracts and orders concluded between the entrepreneur and the consumer.
Before concluding a distance contract, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the conclusion of the distance contract that the General Terms and Conditions are available for inspection at the entrepreneur and will be sent to the consumer free of charge as soon as possible upon request.
If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the conclusion of the distance contract, the text of these General Terms and Conditions may be made available to the consumer electronically in such a way that the consumer can easily read it and store it on a durable medium. If this is not reasonably possible, before the conclusion of the distance contract, the consumer will be informed where the General Terms and Conditions can be accessed electronically and that they will be sent to the consumer free of charge electronically or otherwise upon request.
If, in addition to these General Terms and Conditions, specific product or service conditions apply, the second and third paragraphs shall apply accordingly, and the consumer may always invoke the provision most favorable to them in case of conflicting terms.
If one or more provisions of these General Terms and Conditions are or become wholly or partially invalid or lose their effectiveness at any time, the remainder of the contract and these General Terms and Conditions shall remain unaffected, and the relevant provision shall be replaced immediately by mutual agreement with a provision that approximates the original provision as closely as possible.
Situations not regulated in these General Terms and Conditions must be considered "in the spirit" of these General Terms and Conditions.
Any uncertainty regarding the interpretation or content of one or more provisions of our General Terms and Conditions must be interpreted "in the spirit" of these General Terms and Conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer is non-binding and subject to change. The contractor has the right to modify and adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. If the entrepreneur uses images, they provide a truthful representation of the products and/or services offered. Obvious errors or mistakes in the offer do not bind the entrepreneur.
All illustrations and specifications in the offer are indicative and cannot constitute grounds for compensation or contract termination.
Product images truthfully represent the products offered. The contractor cannot guarantee that the displayed colors exactly match the actual colors of the products.
